Acceptance
These terms (the “Terms”) govern your use of the website at breatheair.ai (the “Site”) and any related materials we make available through it, including the early-access programme for AIR.
By using the Site or registering for the early-access programme you agree to these Terms. If you do not agree, please do not use the Site.
Definitions

| “Content” | All text, images, code, designs, and materials published on the Site. |
| “AI Output” | Any text, recommendation, action, or other artefact generated by AIR or a third-party language model accessed through AIR. |
Use of the website
You may use the Site to learn about AIR, register interest, and contact us. You may not:
- Scrape, copy, or republish substantial parts of the Site for competing or commercial purposes without our written permission.
- Attempt to gain unauthorised access to our systems.
- Interfere with the Site’s operation, including by automated traffic, denial-of-service, or vulnerability probing without prior written agreement.
- Use the Site in any way that breaks applicable law.
The early-access programme
The early-access programme is an opportunity to use AIR before general availability. Participation is by invitation only and is subject to:
- No guarantee of access. Registering interest does not entitle you to a place in the programme. We select participants at our discretion based on fit.
- A separate customer agreement. Selected participants will sign a pilot or subscription agreement before any production use of the Platform.
- Pre-release status. Until general availability, the Platform is in active development. Features may change, break, or be withdrawn. We make no service-level commitments unless explicitly set out in your customer agreement.
- Feedback. If you provide us with feedback, suggestions, or ideas about AIR, you grant us a perpetual, irrevocable, royalty-free licence to use them. You don’t have to give us feedback — but if you do, we can act on it freely.
Acceptable use
You must not use the Site, the Platform, or any AI Output to:
- Break the law or facilitate illegal activity.
- Generate or distribute content that is harassing, defamatory, fraudulent, hateful, or sexually explicit involving minors.
- Make decisions affecting individuals that the law requires to be made by a human, or that produce legal or similarly significant effects without appropriate human review.
- Provide regulated advice (medical, legal, financial, etc.) to third parties without appropriate professional oversight.
- Probe, scan, or test the vulnerability of our systems or any system or network connected to AIR without prior written agreement.
- Reverse-engineer, decompile, or attempt to extract source code from the Platform.
- Use AIR to develop a competing product.
Breaching this section is grounds for immediate termination of your access.
AI outputs & disclaimer
AIR generates content using large language models. AI Outputs are generated probabilistically and may be:
- Inaccurate. Models can produce confident-sounding text that is factually wrong.
- Biased. Models reflect biases in their training data.
- Inconsistent. The same prompt can produce different outputs at different times.
- Outdated. Models have a training cutoff and do not know recent events without explicit context.
You are responsible for reviewing AI Outputs before relying on them. AIR is a productivity tool, not a substitute for professional judgement. For decisions with legal, financial, medical, or safety implications, you must apply human review.
We do not warrant that AI Outputs are accurate, complete, current, or fit for any particular purpose. We disclaim, to the maximum extent permitted by law, liability for any decision you make in reliance on AI Outputs.
Intellectual property
All Content on the Site, the AIR brand, the AIR wordmark and symbol, and the underlying Platform are the intellectual property of Glowar Ltd or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to access the Site for the purposes described in these Terms.
AI personas generated by AIR (their names, role descriptions, capability profiles) are part of the Platform. Customers receive a licence to use the personas they hire under their customer agreement; ownership of the persona definitions, models, and underlying infrastructure remains with us.
Your content. If you upload or input data to the Site or Platform (e.g. through the early-access form, or in a pilot), you retain ownership. You grant us the rights we need to operate the Site and Platform on your behalf.
Confidentiality
During the early-access programme we may share information about AIR that is confidential — roadmap, internal pricing, unreleased features. You agree to treat such information with the same care you would treat your own confidential information, and not to disclose it to third parties without our written permission. This obligation lasts for three years from the date the information is disclosed.
Your data
How we handle personal data is described in our Privacy Policy. For the Platform, a Data Processing Agreement forms part of your customer agreement and governs our processing of personal data on your behalf.
Disclaimer of warranties
The Site and (during early-access) the Platform are provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all warranties — express, implied, statutory, or otherwise — including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Nothing in this section excludes or limits liability that cannot be excluded under English law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.
Limitation of liability
To the maximum extent permitted by law, our total aggregate liability arising out of or in connection with your use of the Site or participation in the early-access programme is limited to £100.
We are not liable for any:
- Loss of profits, revenue, business, or goodwill;
- Loss of anticipated savings;
- Loss of or corruption to data;
- Indirect, special, or consequential loss.
Where you become a paying customer, liability is set in your customer agreement and supersedes this section.
Indemnity
You agree to indemnify Glowar Ltd against any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site or any AI Output, or your violation of any applicable law.
Termination
We may suspend or terminate your access to the Site or the early-access programme at any time, with or without notice, if we reasonably believe you have breached these Terms or for any other lawful reason.
You may stop using the Site at any time. Sections that by their nature should survive termination (intellectual property, confidentiality, disclaimers, limitations of liability, indemnity, governing law) will continue to apply.
Changes to these terms
We may update these Terms from time to time. The “last updated” date at the top of this page reflects the current version. For material changes we will notify early-access participants by email. Continued use of the Site after a change constitutes acceptance of the updated Terms.
Governing law and jurisdiction
These Terms are governed by the laws of England and Wales. Any disputes arising out of or in connection with these Terms are subject to the exclusive jurisdiction of the courts of England and Wales.
